The separation of a premises involves the creation of a property that is part of a building, designated under specific regulations from the remaining part of that building due to a distinct object of ownership. This occurs through an agreement executed in the form of a notarial deed, which serves as the basis for entry in the land and mortgage register. Each owner of a separated premises also has a share in the common parts of the building and the land. This share corresponds to the ratio of the usable area of the premises, including the area of ancillary rooms, to the total usable area of all premises along with their ancillary rooms. When establishing separate ownership of residential premises in buildings owned by the State Treasury or local government units, encumbered by a lease for an indefinite period, the transfer of the right of separate ownership of the premises may be made to the current tenant without a bidding process, and the tenant has the right of first refusal.
